Maryland Set to Become Sixth State with EPR Law
April 10, 2025 | The state of Maryland is poised to join a growing number of states implementing extended producer responsibility (EPR) laws, following the passage of SB 901 by both chambers of the state legislature on April 8.
The bill now awaits action from Governor Wes Moore, who has 30 days to sign or veto it. If no action is taken, it will become law by default. The Governor is expected to sign the bill, which would make Maryland the sixth state in the U.S. to adopt an EPR program for packaging and paper products.
SB 901 establishes a producer-funded system aimed at reducing packaging waste and increasing recycling efficiency across Maryland. Modeled closely after Minnesota’s EPR law, the bill will impose new obligations on producers of packaging and paper products, with implementation beginning July 1, 2026. Key producer deadlines for that date include producer and producer responsibility organization (PRO) registration, alternative collection program eligibility, and recycling service provider reporting.
The Maryland Department of the Environment (MDE) will oversee the program, including establishing a list of recyclable materials and conducting a statewide needs assessment.
